BYE-LAW X - Smoking on Club Premises
1. In line with the Smoking in Public Places (2003) Regulations, which
came into force on the 5th April 2004, all areas of the MUC are to be
considered as “N0 Smoking” areas, with the exception of the following
rooms/areas:
a) Ground floor: the open space around the tennis court;
b) 1st. floor: the open terrace;
c) 2nd floor: the card room designated as the floor’s “Smoking Lounge”.
Smoking is also permitted on the balcony surrounding the Cafeteria,
Lounge and the card rooms.
d) 3rd floor: the outdoor area.
2. The Secretary and/or Committee of Management Members may
request/order a member and/or guest upon breaking this regulation to
leave the premises. The member concerned may also face further
disciplinary action as may be decided upon by the Committee of
Management or Disciplinary Board.

a) Should any fine/action be imposed legally by the pertinent
authorities on the Club secretary, as the Club’s employer, or any member
of the Committee of Management, as a consequence of a club member or
guest breaking the smoking laws in force, the relevant fine/action will
be automatically passed on to the member concerned, regardless of
whether the guest or the member was the offender.
b) Moreover, any legal or other expense incurred by the Club on such
action will also be borne by the member concerned as in 3 a). If however
the club is fined, and/or has to incur expenses, then, not only must the
member bear the expense, but he will also be suspended for a minimum of
three months, or expelled (as the Committee of Management/Disciplinary
Board may decide, which decision cannot be challenged).
4. Where no fines or expenses are incurred, then the offending member’s
case will be regulated as follows:
a. 1st time: written warning, to be handed to the member by the
Secretary or sent by registered post at the address on the Club
membership list as advised by the member himself;
b. 2nd time: suspension of 3 months;
c. 3rd time: automatic expulsion.
All the above disciplinary steps are to be notified to the member by
registered and regular post at the address on the Club Membership List
as advised by the member himself.
